Announcement of fee rates for PEI Lamps program commencing April 1, 2015

The Prince Edward Island MATERIALS STEWARDSHIP AND RECYCLING REGULATIONS, pursuant to the requirements of the Environmental Protection Act R.S.P.E.I. 1988, Cap. E-9, require the implementation of a product stewardship program for the collection and processing of Lamp products in PEI.  The designated lamp products include all lamp technologies and sales to all users.

Product Care’s PEI LightRecycle program plan has been approved by PEI’s Department of Environment, Labour and Justice and may be viewed here.

The PEI LightRecycle program will be funded by Environmental Handling fees or ‘’EHFs’’ applied to the sale or supply of new Lamp Products on the market in PEI.

The EHF rates, effective April 1, 2015, are as follows:

The EHFs will be paid to the program by program members (manufacturers, distributors, retailers etc.) and will be used by Product Care to fund all program costs including the collection, transportation and recycling of end-of-life products, in order to deliver a program that provides no cost collection service for both residential and industrial, commercial and institutional (ICI) sectors.  Please note that the EHFs payable to Product Care by program members are subject to tax (HST).

It is the decision of each member of the program how to manage the cost represented by the EHFs payable to the program.  Note the provisions in the Regulations with regard to fees and the display by retailers of education and awareness material at point of sale:

54. No retailer shall charge a consumer any separate fee with respect to the costs associated with implementing or operating a lamp product stewardship plan. (EC349/14)

55. A retailer shall prominently display, at the point of display or the point of sale of a lamp product, the education and awareness program information referred to in clause 50(3)(e) that is supplied to it by the brand owner or the brand owner’s agent. (EC349/14)

Collection system:  The collection system currently includes the six Island Waste Management Corporation (IWMC) collection sites across PEI.  All sites accept residential quantities of lamps.  Commercial users must contact the IWMC collection site before bringing a large volume of lamps.  PCA plans to expand the collection system.  Any member interested in becoming a collection site should contact Product Care.
